The Petition

Registers containing the names of voters in the Bura election petition were missing from ballot boxes opened during a recount and scrutiny exercise.
Out of the 16 ballot boxes opened, only one from the Ngamano polling station contained a register that detailed the number of voters who participated in the process.
Altered forms
During the recount at the Mombasa Law Courts, it was also noted that very few ballot boxes had been sealed with counterfoils inside.
In the petition, Mr Abdulrehman Halkano, who was a Kanu agent representing Wario, is challenging the election of Nuh during last year’s General Election.
Nuh, who was vying on an ODM-Kenya ticket, won by 6,259 votes against Wario’s 6,000.

FALLOUT LIKELY IN BURA AFTER KANU NOMINATIONS

Mr Mohammed Galgalo holds the record of being the only Kenyan to have represented three different constituencies in the same district as an elected member of Parliament.

He represented Garsen, once known as Tana South, for two terms between 1974 and 1979 and 1979 and 1983 and Galole from 1988 to January, 1991. He lost the seat on January 17, 1991, when he was sentenced to a jail term. He bounced back in 1997, when he was elected MP for Bura on a Kanu ticket.

Mr Galgalo had in-between put in a bid for the Galole seat on a Ford Kenya ticket in 1992. Although he lost, he remained the senior-most Opposition figure in Tana River, with a high post in the Ford-K executive committee, until he suddenly switched to Kanu in preparation for the fight for the Bura seat in 1997.
Indications on the ground are that he should have little trouble retaining the seat.But he will have to watch out for the candidacy of Mr Ali Wario, who ran against him on the National Development Party ticket in 1997 and emerged a close second. Now that NDP has merged with Kanu, Mr Wario is almost certain to challenge Mr Galgalo for the ruling party's nomination. Others expected to try their luck against the MP are Mr Hassan Odha, Mr Mahad Loka, Mr Hussein Wario and Mr Ali Saidi, all who stood on various Opposition tickets in 1997 and are now reported to be weighing their options.

Since Bura was carved out of Galole constituency in 1997, the Wardei, who are the majority ethnic group in the area, have called the political shots.Both Mr Galgalo and Mr Wario are Wardei and theirs is likely to be a two-horse contest. Other minor tribes such as the Orma, the Malakote, the Wata and the Monyoyaya, are unlikely to field any candidates and will most likely support the man who wins the backing of the majority Wardeis.

Mr Wario is the chairman of the Livestock Council. He has been active in the organisation of livestock traders in the whole of the Coast and North Eastern provinces. His popularity stems from the fact that he is persistent in championing issues concerning pastoralists. He also has the advantage of being on the ground in the region.
Key issues likely to dominate the campaigns include livestock marketing and water and pasture for livestock. Others will concern the revival of the Bura Settlement and Irrigation Project.The collapse of the scheme in the mid 1980s has led to food shortages and increase in poverty levels. Some attribute frequent bandit attacks to the poverty caused by the stalling of the scheme.

One possible scenario in the coming election could be a bruising battle for the Kanu nomination between Mr Galgalo and Mr Wario in which the loser, if particularly aggrieved, might move to the Opposition.Some of the parties associated with the National Alliance for Change and the groupings around Mr Simeon Nyachae's Ford People are said to be quietly scouting the scene and would no doubt be happy to benefit from a fallout in Kanu.
